In case, if the client/ clients or the tour or any part of the tour thereof cannot be performed due to Force Majeure, Holiday Tram (a unit of SHAVIK Hospitality Services) shall not be accountable to give any refund to the client. Nevertheless, at its sole discretion, Holiday Tram provides the refund based on several factors like the number of pax, and the cancellation codes of suppliers like airlines, coach operators, hoteliers, etc. Moreover, the verdict/ decision of Holiday Tram on the quantum of refund shall be the final.

In the case that the client/ clients do not or cannot avail any of the services like rides, meals, cruises, hotels, sightseeing, entrance fees, optional tours, etc., due to any reason whatsoever, then Holiday Tram is not liable for any refund.

Refunds (if any) for cancellation and/or amendments will be remunerated directly to the client for booking made directly with Holiday Tram by way of UPI / IMPS / NEFT / RTGS / Crossed cheque or by credit card it will be reversed to the client's credit card account at the discretion of the company.

It has to be taken into notice that it would take at least a minimum of 15 to 45 days to process the refund (if due).

For any service or tour booked in advance and canceled as per booking policy, the refund will be made in the same mode of payment after deducting cancellation charges and actual bank charges if any for the refund.

Clients have the option to keep their refund money in Holiday Tram's account and collect a credit certificate and consume the same within 24 months of the cancellation date.

Protocols for commencing the travel/ tour:

1) It is the responsibility of the client to strictly follow the tour program bought through Holiday Tram. It shall be noted that there won't be any refund if the client fails to commence the tour on the said date or fails to join the group at the commencement of the tour, joins the group later, or leaves the group or tour before it ends due to any reason or whatsoever.

2) It shall be noted that Holiday Tram will charge a 100% cancellation and no claim shall be entertained for refund of any unutilized services in the case where a client along with his/ her family is compelled to discontinue the travel/ tour in the mid, due to any reason whatsoever including death, illness, or loss of any travel documents. Also, in the case, if a client is not able to reach the place/ venue of commencement of the travel due to any reason whatsoever including loss of baggage or other, his/ her booking shall be considered as a "no show" on the tour and 100% cancellation charges will be levied on the client/traveler.

3) In case a client/clients avail pre-tour services or part thereof, or air tickets (in case the departure city of commencing the tour is different) but fail to catch up or join the tour or group for the main tour at the pre-defined or appointed venue or place, or cancel the trip after using the pre-tour arrangements, air tickets or part thereof, it shall be treated as "no show" and Holiday Tram is not liable for any refund to the client for the unutilized pre-tour or main tour services.

4) It shall be noted that Holiday Tram reserves the right to withdraw the tour membership/ cancel the tour services of any client or clients whose behavior is deemed likely to affect the smooth operation of the tour or adversely affect the safety or peace of other passengers and the company shall be under no liability to any such person(s).

5) It shall be noted that the client/ clients can ask to amend the package itinerary one week before the travel date. After that, no changes will be entertained by the company. If the client wants to make changes in the itinerary a few days before the travel or while being on-ground, then the changes asked for will be solely dependent on the availability of the aforesaid requirement(s). Nevertheless, if the client/ clients wish to avail a particular service like hotel change, any activity (not included in the package), any sightseeing tour (not included in the package), or other services which were not included at the time of booking or the service or sightseeing tour that was inquired before but not included at the time of booking, then he/ she can avail the service after paying the extra charges conveyed to the client by the company on the spot. Holiday Tram won't be held responsible for any change in the amount of the said service if enquired earlier by the client for the same from any of the representatives of the company.

6) The immunities given under this contract shall be available to Holiday Tram's employees, managers, directors, and agents but not to the Independent Contractors selected by the company.

7) All of the conditions above shall be severable from the other and if any provision is illegal, invalid, or unenforceable, the remaining provisions shall nevertheless have full force and effect. There won't be any liability on the part of Holiday Tram arising in any way out of the contract in respect of any holiday, travel, trip, tour, or excursion facilities shall exceed the total amount paid or agreed to be paid for the tour or holiday, and shall in no case include any consequential, incidental loss, or additional expense whatsoever.

8) It is the duty of the client to procure Holiday Insurance before traveling. The client may obtain travel insurance (optional) at their own cost.

9) The amount quoted in Holiday Tram's website/brochure has been calculated at the rate prevailing at the time of publishing/printing. Holiday Tram reserves the right to change or amend the prices published on the website or in the brochure in case of special/high season charges incurred by the suppliers, fuel costs, hikes in the airline charges before the date of departure, and surcharge accordingly. The client must pay for all such hikes in price in full before the departure.

10) In case Holiday Tram publishes any travel-related offer or scheme that proposes any discount or benefit, Holiday Tram shall have the sole right to withdraw such a discount or scheme at any time unless a particular or specific assurance of the contrary is published by the company.
